Using "Soliciting a Minor" Charges to Put Away Spammers For Life


I think that there is one topic that has been grossly underreported but is of great importance. That is the war on spam. Now I am aware that most people think that there is not much that can be done about it and this is further brought about by the fact that some of the most virulent spammers out there are getting barely a slap on the wrist when one considers the damage and cost they incur on the public at large.

I believe that this is because the incorrect approach that law enforcement officials have been making in their attempts to come up with charges that can stick during their investigations of these spammers. To combat this, I believe that we can take a lesson from the innovative approach that the Feds took when trying to take down Al Capone. He managed to escape all attempts to prosecute him until the Feds came up with the idea of nailing him on income tax evasion. This turned out to be the one charge that he could not talk his way out of.

I am not suggesting that we use income tax evasion in the prosecution of spammers, however. I do propose something perhaps far more effective, instead. Hit the spammers with charges of soliciting pornography to minors. That would be something that would carry some teeth to it and something that they would find very little wiggle room to escape from.

The way I see it is that if I took any one of the spam messages that I receive that purport to sell various penis enlargement and sexual enhancing remedies and started using the same verbiage in a chat room with a minor child, the authorities would be very quick to lock me up and throw away the key.

So, that being said, what is the difference between sending these messages to a minor child in a chat room and sending the same messages to my 13 year old daughter's email inbox? Sorry, but I cannot see that there is any difference at all. So, if the law enforcement community wants to go after these bad guys, perhaps all they need is a slightly different approach, such as the one I am suggesting here.
